Salmain: Rejects Request

The Magistrate Council rejected federal judge Gastón Salmain’s request to suspend the deadlines of his case, while he was processed under preventive imprisonment in Rosario.

The Accusation Commission, chaired by Senator Luis Juez, denied the defense’s proposal to pause the file in January due to a family trip to Madrid. The judicial fair had been formally authorized to continue the proceedings.

The defense requested that the deadlines begin on January 19, 2026, arguing that it was "materially impossible" to exercise their right of defense during the travel period. They provided flight tickets as supporting evidence.

Meanwhile, Federal Judge Carlos Vera Barros processed Salmain with preventive imprisonment and prohibited him from leaving the country, citing procedural danger. The same resolution also processed entrepreneur Fernando Whpeiy and judicial operator Santiago Busaniche, banning them from leaving.

Salmain is involved in an investigation of maneuvers linked to former federal judge Marcelo Bailaque, where Whpeiy declared repentance and used Salmain to obtain a precautionary measure. The court ordered an embargo on assets.

"Teniendo especialmente en cuenta que la feria fue oportunamente habilitada por decisión expresa de la totalidad de los miembros de la Comisión, el criterio fijado por este Presidente respecto al cumplimiento de los plazos procesales, así como la gravedad institucional del caso y la trascendencia de los hechos investigados, no resulta atendible la pretensión" — Juez said.
